What’s The Case About?
Our firm, Capstone Law APC, along with co-counsel, is litigating a class action lawsuit on behalf of consumers who purchased or leased a 2015-2019 Chevrolet Silverado; 2017-2019 Chevrolet Colorado; 2015-2019 Chevrolet Corvette; 2016-2019 Chevrolet Camaro; 2015-2019 Cadillac Escalade and Escalade ESV; 2016-2019 Cadillac ATS, ATS-V, CTS, CT6, and CTS-V; 2015-2019 GMC Sierra, Yukon, and Yukon XL, and Yukon Denali XL; or 2017-2019 GMC Canyon vehicle equipped with a General Motors’ Hydra-Matic 8L90 transmission or Hydra-Matic 8L45 transmission manufactured, marketed, and distributed by General Motors LLC. The lawsuit, entitled
Shelton v. General Motors LLC, is currently pending in the United States District Court for the Eastern District of Michigan, Case No. 2:19-cv-11044. The lawsuit alleges, among other things, that General Motors:
- failed to disclose that these transmissions contain certain defects that cause slipping, bucking, kicking, jerking, and harsh engagement; suffer abnormal internal wear, sudden acceleration, delay in downshifts, delayed acceleration, and difficulty stopping the vehicle; and eventually result in transmission failure that requires replacement; and
- failed to disclose these defects create a safety risk, because they severely affect the driver’s ability to control the car’s speed, acceleration, and deceleration and increase the risk of collisions.
We believe that General Motors' advertising and marketing of the vehicles described above misled consumers in violation of consumer laws and that consumers who purchased and used these vehicles suffered damages based on the omission of material information relevant to their purchasing decisions.
